In addition to the decision of the Munich higher regional court dated 18.01.2017 (3 U 5039/13), the Cologne higher regional court has also handed down a decision (5 U 64/16), 08.04.2020, in which the court concludes that a functional analysis would be essential before the restoration. Neglecting the available screenings before starting the prosthetic restoration is considered a diagnostic error (see also https://bit.ly/2HZhZqa).
